End User License Agreement (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “You”) and “Everything That Can Happen” Project (“Company,” “We,” or “Us”) for the use of the “Everything That Can Happen” platform and related services (the “Service”).

By creating an account, accessing, or using our Service, you agree to be bound by the terms of this EULA.

1. Grant of License

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or commercial storytelling purposes.

2. Permitted Uses

You may use the Service to:

Create, edit, and publish interactive stories
Generate AI-powered content and images for your stories
Share your stories with other users
Collaborate with other users on storytelling projects
Access and play stories created by other users

3. Prohibited Uses

You may NOT:

Reverse engineer, decompile, or attempt to extract the source code
Use the Service for illegal, harmful, or offensive content
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service or servers
Create content that infringes on others’ intellectual property rights
Use the Service to spam, harass, or harm other users
Resell, redistribute, or sublicense access to the Service
Use automated tools to scrape or extract data from the Service

4. User Content

4.1 Your Content Rights

You retain ownership of the stories, text, and creative content you create using the Service (“User Content”).

4.2 License to Company

By uploading User Content, you grant us a worldwide, royalty-free, non-exclusive license to:

Host, store, and display your User Content on the Service
Process your content through our AI systems for story generation
Create backup copies for service reliability
Moderate content for compliance with these terms

4.3 AI-Generated Content

Content generated by our AI systems based on your prompts becomes your User Content, subject to the same terms above.

4.4 Open Content License (Free to Use by Anyone)

To make stories created on the platform broadly useful and remixable, you irrevocably dedicate all User Content you create on the Service to the public domain under the Creative Commons CC0 1.0 Universal (Public Domain Dedication), to the maximum extent permitted by law. Where such a dedication is not legally permissible, you grant to the public a perpetual, worldwide, non-exclusive, irrevocable, royalty-free license to use, copy, reproduce, distribute, modify, adapt, create derivative works from, publicly perform, and publicly display your User Content for any purpose, including commercial use, without attribution or compensation.

Note on Personal Data: The CC0/public license grant does not waive or limit your data protection rights. Do not include personal data in User Content. If personal data is inadvertently included, you may request erasure; we will take reasonable steps to remove personal data from the Service and stop further distribution under our control. Public copies already accessed or reused under the public license may not be fully retractable.

4.5 Publication and Moderation Rights (Stories and Story Nodes)

We reserve the right, in our sole discretion and at any time, to publish, unpublish, remove, or delete any story or story node (in whole or in part) for any reason, including but not limited to violations of this EULA, legal compliance, safety, quality, performance, or operational considerations. We may also restore previously unpublished content at our discretion.

5. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into this EULA by reference. See our Privacy Policy at /documentation/privacy for full details on data categories, purposes, lawful bases, retention, recipients, international transfers, cookies, and your rights.

6. Service Availability

The Service is provided “as is” and “as available”
We do not guarantee uninterrupted or error-free service
We may modify, suspend, or discontinue the Service at any time
We will provide reasonable notice for planned maintenance

7. Account Termination

7.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features.

7.2 Termination by Us

We may suspend or terminate your account if you:

Violate this EULA or our terms of service
Engage in fraudulent or illegal activities
Fail to pay applicable fees (if any)

8. Intellectual Property

The Service, including its design, functionality, and underlying technology, is proprietary to us
Our trademarks, logos, and branding materials are our exclusive property
You may not use our intellectual property without written permission

9. Disclaimers and Limitations

9.1 Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION.

9.3 Maximum Liability

Our total liability to you for any claims arising from this EULA or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You have the right to request access, rectification, erasure, restriction, and portability of your personal data, and to object to processing where applicable (including direct marketing). You may withdraw consent at any time. To exercise these rights, contact [privacy@automagical.games]. You may also lodge a complaint with your local supervisory authority.

Data Processors and International Transfers

We use service providers to host and operate the Service (e.g., cloud hosting, email delivery, content storage). Some processing may occur outside your country, including outside the EEA/UK. Where required, we rely on Standard Contractual Clauses and equivalent safeguards. A list of key processors and safeguards is maintained in our Privacy Policy.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of [Jurisdiction to be specified], without regard to conflict of law principles.
